When a School Can Bar a Student From Prom
With High School students gearing up for prom season, it’s important to remember that most proms are school sponsored events. As a result, if a student is subjected to discipline from their school, they could be forbidden from attending their prom.
School Districts have the power to discipline a student for a violation of the School District’s code of conduct. Before any such discipline is imposed, a student has the right to an informal meeting with the principal or a superintendent’s hearing, depending on the length of the suspension. As part of any suspension a student could be forbidden from attending any school related functions, including prom, regardless of whether or not the event is to be held on School District property. This would include a school prom held at a private venue off school grounds.
The Commissioner of Education has ruled that School Districts also have the authority to set specific criteria that must be met by a student in order to attend the school sponsored prom. If these requirements are not met, the school has the power to forbid the student from attending prom.
However, with the assistance of an experienced School Law attorney, a School District may be willing to negotiate terms under which a student forbidden from attending prom could attend. Prom is a meaningful social experience for many students, and to some, it is extremely important. If your child has become subject to this sort of prohibition, contact a skilled School Law attorney immediately for help.
